Standing corrections (added at publication, August 23, 2026). Two statements in this issue have been overtaken. The 2026 U.S. bank failure total is five, not four — Tioga-Franklin Savings Bank, Philadelphia, failed on August 21. And the reading of the OCC digital-asset roster below as “a record of applications received rather than a live queue” is wrong; approved applicants do come off the list on a short lag, and the roster fell to twelve when World Liberty was removed. Materiality thesis: The OCC's digital-asset charter pipeline moved again on Thursday, and the item that moved is the most politically exposed application on the roster. The decision itself is narrower than the coverage of it — preliminary, conditional, and explicitly not authority to open — and the gap between what the letter says and what the market will hear is the story worth carrying to a board.


1. Charters and the banking perimeter

World Liberty Trust Company receives preliminary conditional approval from the OCC.

Fact. On August 14 the OCC granted preliminary conditional approval of the application to charter World Liberty Trust Company, National Association, a proposed uninsured national trust bank to be headquartered in Bay Harbor Islands, Florida. The applicant of record is SC Financial Technologies, LLC. The decision letter states that final approval and authorization to commence business have not been granted and will not be until all pre-opening requirements are met, that the OCC retains the right to modify, suspend or rescind the approval, and that the bank is required to apply for Federal Reserve Bank stock. The application was received January 6, 2026 — a little over seven months from receipt to preliminary decision.

Interpretation. Three things are worth separating. First, preliminary conditional approval is not a charter, and the distance between the two has already been demonstrated inside this pipeline: one applicant on the same roster had its application returned in July, and another was denied outright in August. Second, the required application for Reserve Bank stock puts the Federal Reserve in the path, and Fed payment-system access is a separate decision from the OCC's — the register records that status as unknown, because it is. Third, and most usefully for a board: the OCC has now issued preliminary conditional approvals across a full spread of applicant types, from established custody and payments firms to politically-affiliated newcomers, while separately returning and denying others. The signal is not "the door is open" — it is that the OCC is now clearing applications individually and on the merits, at pace, in both directions.

Lifecycle. Pending → Conditional Approval (preliminary), August 14, 2026. Final approval outstanding.

Perimeter roster unchanged otherwise. Thirteen applications sit on the OCC's digital-asset licensing list. No new applicant appeared this week and no applicant dropped off — and it is worth noting that World Liberty remains listed after its approval, which confirms the list is a record of applications received rather than a live queue of undecided ones.


2. Bank and holding-company transactions

No new transactions announced.

Santander / Webster remains on track for August 20. All approvals are in hand — OCC in June, European Central Bank in July, Federal Reserve on August 4. At roughly $12.3bn this is the largest completion in the current pipeline and it lands inside the next week.

FS Bancorp / Pacific West cleared the Federal Reserve on August 9. The Pacific West shareholder vote remains unconfirmed at time of writing; closing is guided to the third quarter.


3. Credit unions

No new NCUA action. The most recent resolution of any kind remains the closure of African Diaspora Federal Credit Union on August 6. Two conservatorships opened earlier in 2026 — WeDevelopment and Jackson Area — remain unresolved.


4. Failed banks and resolutions

No new failures. The 2026 total stands at four.


5. Policy and supervisory environment

Two FDIC actions from the past week bear on the charter pipeline and should be read together rather than separately: a revised two-phase process for reviewing deposit-insurance applications, and the rescission of the 2009 Statement of Policy on Qualifications for Failed Bank Acquisitions. The first reshapes how de novo applicants reach insured status; the second is explicitly aimed at widening the field of bidders for failed institutions.
